Candidate for 225th District Court

The 225th District Court is a civil trial court that represents ALL WHO LIVE IN BEXAR COUNTY! The 225th, like the other twelve civil district courts in Bexar County, handles cases involving families, small businesses, homeowners, employees and employers, nursing homes, health care, automobile accidents, business damages, taxes, contracts, eminent domain, municipal issues, oil and gas, complex business litigation, and much more. My Democrat opponent has led many to believe the 225th District Court is only a children and family court because his experience is in child abuse.

I ask for your help to get the word out that this court works for all people in Bexar County, and it requires a jurist with the experience in the board base of cases that comes before this court. I am the only person in this race with the necessary board base of experience, and I ask you as leaders in the Republican Party for your support.

As a former school teacher, social worker, Assistant United States Attorney in civil litigation, personal briefing attorney to judges at the state, federal, trial and appellate levels, corporate counsel, and private attorney, I have handled a wide variety of cases. I have the broad base of experience that is needed and judicial temperament to be the Judge of the 225th District Court. I will not legislate from the bench, and I will serve as a hard-working, strong work ethic, and fair and impartial jurist.

Biographical Information

Marialyn Barnard is an experienced attorney with a broad understanding of the law. Ms. Barnard started her legal career working for different courts including state appellate courts and a federal trial court. Her early experiences include internships at the Texas State Supreme Court for former Justice John Cornyn and the Texas Court of Criminal Appeals former Judge Charlie Baird. Marialyn's legal career has spanned working for several judges, litigating as an Assistant United States Attorney, and being a corporate counsel. She was also a high school teacher for many years and has worked as a social worker in the Food Stamp and Aid to Families with Dependent Children Programs.

Marialyn Barnard attended school in San Antonio and graduated from Samuel Clemens High School in 1971. Her father retired as a United States Air Force officer at Randolph A.F.B., and her family settled in Bexar County. She attended San Antonio College, Abilene Christian University, University of Texas at San Antonio, and graduated from Texas A&M Commerce in 1983. She graduated from St. Mary's University Law School in 1992, and worked at the Fourth Court of Appeals for Justice Orlando Garcia on civil and criminal appellate cases including, Commercial Litigation, Family Law, Oil and Gas , Premises Liability, Employment Law, Personal Injury, Negligence/Wrongful Death, Consumer Protection and Criminal Law

She also worked with all of the justices including former Justices Blair Reeves and Carlos Cadena (as visiting judge) for whom the Bexar County Justice Center is now named.

In 1994, Marialyn worked at the United States District Courts for Judge Orlando Garcia. Marialyn worked again on a variety of civil and criminal cases including, ,Intellectual property, Employment Law, Voting Rights, Health Care, Defense Contracts, Child Custody/Kidnapping, Bankruptcy, Tort Law and Criminal Law

As a result of Marialyn's broad legal experience, in 1995 she became an Assistant United States Attorney for the United States Department of Justice. She handled various types of complex civil litigation cases in the Western District of Texas. At the U.S. Attorney's Office, Marialyn was selected for an "On the Spot Award" and a "Time-Off Award." After a few years, she was selected in a competitive selection process by the United States Department of Justice for a special detail to train and establish trainings for other Assistant United States Attorneys and Department of Justice attorneys. The training areas included trials, appeals, evidence, and substantive law areas such as civil fraud, health care, and defense contract fraud.

Marialyn has also worked as a corporate attorney for CPS Energy in San Antonio and as a managing director of Forensic and Litigation Services for KPMG where she worked on mergers and acquisitions, compliance, and employee issues for individuals and corporate clients.

Complimenting Marialyn's strong legal knowledge and court experiences and her teaching and social worker experiences, Marialyn has tirelessly volunteered time to our community through her legal profession as well as through numerous charities.

Marialyn is married to Gary Barnard, PhD. psychologist in private practice who works with families. Gary is her high school sweetheart, and they have been married thirty-three years. They have two grown children. Their daughter is Brandi Barnard Cone a U.S. Air Force Reserve C-5 pilot with the 433rd, married to Brandon Cone, Market Maker, Chicago Board of Options Exchange. Their son is Joshua Caleb Barnard, a college student and private pilot aspiring to be a military pilot.

JUDGE RENE DIAZ : 224TH DISTRICT COURT of BEXAR COUNTY, TEXAS

Rene Diaz is one of the newest judges in the Bexar County Courthouse. Governor Rick Perry appointed Judge Diaz to the Bench of the 224th District Court in January 2005 to fill a vacancy left by the retirement of Judge David Peeples. The district court where Judge Diaz serves is a civil, not a criminal court. He handles complex civil lawsuits, family law cases and cases involving family violence and child protective services. Judge Diaz is the first Hispanic ever to serve as Judge of the 224th District Court, and he is currently the only Hispanic Republican Judge on the civil side of the courthouse.

For the last 15 years, Judge Diaz practiced law as a civil litigator in San Antonio, representing both plaintiffs and defendants in all types of litigation, in both state and federal court. As a certified mediator and arbitrator, he volunteered to help families and other settle their disputes outside of court. As a corporate and election law attorney, he also served as General Counsel for the Republican Party of Texas before becoming a judge.

Judge Diaz served as a commissioner on the Texas Onestar National Service Commission, overseeing all Texas Americorp volunteers as well as the Texas Office of Faith Based and Community Initiatives. Judge Diaz currently serves on the Bexar County Juvenile Justice Board, The Board of the Bexar County Alternative Dispute Resolution Center and The Board of Habitat for Humanity of San Antonio. He regularly volunteers at the Community Justice Program helping to provide legal and judicial services to poor.

Judge Diaz was born and raised in Virginia (but he got to Texas as fast as he could!). He attended the University of Virginia for his Bachelor's degree in International Relations and Latin American Studies and received both his Masters Degree in Public Policy and his Law Degree from Regent University. He met and married his wife, Cynthia Diaz during law school at Regent, and they lived in San Antonio ever since.
